The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.17 dated

10.02.2017, registered under Sections 420, 120-B IPC at Police Station Division No.2, Pathankot, Punjab.

Heard.

The challan has already been presented; charges have been framed and trial is in progress before the learned Magistrate.

The FIR was registered on the statements of some persons against Smt. Nisha Dogra and her husband Arun on the ground that they are running a

company by the name of Trust-worth Solutions Private Limited at Model Town, Pathankot and both of them had duped Rs.6,50,00,000/- from

different various persons.

The name of the petitioner is not mentioned in the FIR. She is the mother of Nisha Dogra. No amount was deposited in the individual account of the

petitioner. There is no material on record that any amount in cash was entrusted to her. Basically, all the amounts were deposited in the name of

aforesaid company. The said company was being run on the rental accommodation which was arranged by Nisha Dogra. The petitioner is an old

aged lady. The investigation has already been completed and trial is in progress. The petitioner is stated to be in custody since 24.11.2017. No useful

purpose would be served by keeping her in custody.

Without expressing any opinion on merits of the case and keeping in view the fact that conclusion of trial will take considerably long time, the present

petition is allowed. Petitioner Madhu Dogra is ordered to be released on regular bail on furnishing bail bond and surety bond to the satisfaction of trial

Court/Duty Magistrate, subject to following terms:-

(a) The petitioner shall comply with the conditions mentioned in Section 437(3) Cr.P.C.

(b) In the event of his absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn. The trial Court shall be

competent to cancel her bail bond and surety bond and proceed  Â

    to procure her presence in accordance with law. In that eventuality the petitioner shall have to apply for bail afresh.

(c) She shall not leave the country without the previous permission of the Court.
