The Court : GA 3 of 2021 has been filed seeking injunction restraining the respondents from giving effect or further effect to the NIT dated 26thÂ

August, 2020.

The facts of the case are already set out in an order passed by the co-ordinate Bench on 25th September, 2020. Certain interim relief was granted

to the petitioner by calling upon the respondents to give clarifications on the terms of the Notice Inviting tender. The co-ordinate Bench permitted the

petitioner upon clarification to submit its technical bid under the two part tender process.

It appears that no such technical bid has been submitted by the petitioner. Counsel for the petitioner would argue that the clarification given by the

employer on 7th October, 2020 does not constitute sufficient compliance of the order of the co-ordinate Bench dated 25th September, 2020.

It further appears that the writ petition came to be considered again on 20th October, 2020 when after calling for affidavits, the Court had ordered that

the finalisation of tender by the respondents shall abide by the result of the instant writ application. Admittedly, the petitioner has not submitted any

technical bid till date.

This Court is, therefore, not inclined to interfere with the tendering process at all in view of the last part of the order of the co-ordinate Bench dated

20th October, 2020.

Pleadings in the main writ petition have been completed and filed in Court today, the same are taken on record.

The respondents may, if they so choose, file affidavit-in-opposition to the instant application being GA 3 of 2021 within a period of three weeks from

date; reply, if any, shall be filed within a period of two weeks thereafter. Liberty to mention for hearing of the main writ petition after completion of

pleadings in the instant application.
