This petition has been preferred by the petitioner under Section 483(3) read with Section 528 of BNSS, 2023, against the order dated 17.02.2026 passed by learned Judicial Magistrate First Class, Pratappur, District - Surajpur (C.G.) in Criminal Case No. 76/2026, whereby the application preferred under Section 480 of BNSS filed by the accused persons (respondents No. 3 to 14) has been allowed and granted bail to all the accused who have committed offence under Sections 296, 351(2), 115(2), 191(3), 324(4) and 109(1) of BNS in connection with Crime No. 29/2026
Heard on I.A. No. 01/2026, application seeking withdrawal of the petition.
Learned counsel for the petitioner submits that he seeks permission of this Court to withdraw this petition with liberty to file a duly constituted petition before the concerned Court. He also prays to return the certified copy of the impugned order.
Learned State counsel has no objection to this proposition put fourth by the counsel for the petitioner.
Accordingly, the application (I.A. No. 01/2026) is allowed and the petition is dismissed as withdrawn with the aforesaid liberty. Consequently, I.A. No. 02/2026, application for hearing during summer vacation and I.A. No. 03/2026, application for urgent hearing also stand disposed of. The Registry is directed to return the certified copy of the impugned order to the counsel for the petitioner, after retaining a photocopy of the same.
