The counsel Sri Huske Suryakanth for the complainants/petitioners is present before the court physically and submits that this contempt proceedings has been initiated due to non-compliance of the order passed by the learned Single Judge in Writ Petition No.203787/2019 and 218053/2020 (LA-RES) dated 25.08.2020. Whereas, the leaned Single Judge in the aforementioned writ petition passed an order directing the petitioners to furnish a certified copy of the order of the learned Single Judge to each of the respondents along with copy of three representations submitted in the writ proceedings within a period of 7 days.
Learned Government Advocate for accused Nos.1 to 3, learned counsel Sri P.S.Malipatil for accused No.4 and learned counsel Sri Gourish S.Khashampur for accused No.5 are present before the court physically.
Learned Government Advocate submits that in pursuance of the order passed by the learned Single Judge, the proceedings has been initiated in accordance with the observation made therein.
It is further submitted that Rs. 25.00 lakhs has been deposited on 11.02.2022.
If the amount in deposit is made in terms of the order passed by the learned Single Judge the same shall be released in favour of the claimants under due identification. Accordingly, made an observation in this contempt proceedings.
In view of the submission made by the learned Government Advocate for accused Nos.1 to 3 and also submission made on behalf of accused Nos.4 and 5, it is deemed appropriate that for the present this contempt proceedings is dropped.
