This petition has been directed against the orders dated 13.5.1997 and 20.10.1997 passed by the learned trial court. By order dated 13.5.1997 the learned trial court struck off the defence of the defendants. In this order it has been stated that defendants had already availed two effective opportunities for filing written statement and even on that day written statement was not filed. Thereafter, petitioner defendant filed an application for recalling the aforesaid order dated 13.5.1997 and the application for recalling the said order was dismissed by the learned trial court vide order dated 20.10.1997. From the aforesaid order dated 20.10.1997 I find that the defendant/petitioner was granted various opportunities to file the written statement and five opportunities were granted as last opportunities and even then the defendant failed to file written statement. Keeping in view the aforesaid facts, I do not find any merit in this petition and accordingly petition is dismissed.
