Judgment
Heard Mr. D. Julius Riamei, learned counsel appearing for the petitioner and Mr. A. Vashum, learned GA for the respondents.
According to the petitioner, his father was the Chief and after the death of his father, he inherited the Chiefship of Thingou village for which he relied
upon the order dated 02.01.2020 passed by the Addl. Chief Secretary (TA & Hills), Govt. of Manipur. Mr. A.Vashum, learned GA submits that prior
to order dated 02.01.2020, being issued, there was no Chief. As per the provision of the Act, if there was a Village Chief, the Chairman of the Village
authority cannot be elected. In case there is no Chief of the village, the Ex-officio Chairman of the village authority may be elected from amongst the
members.
Let notice be issued to the respondents returnable on 15.03.2021.
List the matter on 15.03.2021.
By way of interim measure, it is directed that the order dated 08.02.2021 shall remain suspended till the next date.
