Chockalingam, J.—Invoking the writ jurisdiction of this Court, the petitioner has sought for a direction to the respondents 3 to 7 to consider the appeal dated 9.1.2010, preferred to the respondents 1 and 2 and subsequently forwarded to the respondents 3 to 7 against the issuance of patta in favour of the 8th respondent in respect of Survey No. 58/9, 58/11 and 58/17 which was classified as Oorani in No. 62, Enmanakondan Village in Ramanathapuram District.

The Court heard the learned Counsel on either side.

From the submissions made by the learned Counsel on either side, it would be quite clear that there was an appeal preferred by the petitioner, and it has been taken on file by the second respondent in the month of January, and the same has been in turn forwarded to the respondents 3 to 7 for disposal.

The case of the petitioner was that the said land has been classified as Oorani, and under the circumstances, patta should not have been granted in favour of the eighth respondent. However, it is the subject matter of appeal which has got to be decided by the authority concerned. Now what are all requested by the petitioner is the early disposal of the appeal. At this juncture, the learned Special Government Pleader brought to the notice of the Court that the appeal has been preferred only in the month of January and it is in progress.

Under the stated circumstances, it would be fit and proper to issue a direction to the respondents 3 to 7 to consider the matter and pass suitable orders as the law would require under the facts and circumstances, within a period of three months here from. Accordingly, a direction is issued, and this writ petition is disposed of. No costs. Consequently, connected MPs are also closed.
