This O.A. has been filed against the inaction on behalf of the respondents for not deciding the representation filed by all the applicants dated 23.03.2022 (Annexure A/3) to the competent authority and no final decision has been taken till date.

From the pleadings, the case of the applicants is that the applicants were appointed pursuance to the policy of substitute Bunglow Peons/Telephone and Dak Khalasis issued by the respondents. The applicants have completed more than 3 years and as per policy, the applicants are to be regularised after completion of screening. The applicants have submitted that they have made the representation (Annexure A/3) to the competent authority, but no decision has been taken.

At this stage, the counsel for the applicants submits that the applicants will be satisfied if the competent authority is directed to decide the representation (Annexure A/3), in a time bound manner.

The learned counsel for the respondents has no objection, if the competent authority is directed to decide the representation of the applicants, on the above lines as per law.

This Tribunal has considered the matter and is of the view that the natural justice will be met if the competent authority is directed to decide the Annexure A/3, in a time bound manner.

Resultantly, competent authority is directed to decide the Annexure A/3, within a period of eight weeks after receiving the order of this Tribunal.

Needless to say that the competent authority shall pass a reasoned and speaking order as per law and also deal with the contentions raised in the representation.

However, it has been made clear that this Tribunal has not touched the merits of the case.

With these observations, this Original Application is disposed of at the motion stage itself.

The applicants are directed to make available the copy of the order of this Tribunal as well as the copy of the Original Application to the competent authority.
