Sanjib Banerjee, CJ

Since the prayer in the application is similar to those in the previous applications allowed by a recent order of this court passed on October 27, 2021, the present applicants are entitled to the same order.

The applicants are similarly situated as the applicants in MC (WA) No.35 of 2020. The applicants have furnished good reasons for condoning the delay in filing their representation. Accordingly, the applicants are permitted to file their representation before the relevant committee within four weeks from date. If the relevant committee deems the applicants to be untainted, the respondent authorities shall revoke the termination of such untainted teacher and such untainted teacher shall continue in service as Assistant Teacher in terms of the order dated December 14, 2018 passed in Review Petition No. 3 of 2018. In case the applicants are found by the relevant committee to be tainted, the consequences as laid down in paragraph 2 of the operative part of the order in WA No.52 of 2011 shall follow.

MC (WA) No. 77 of 2021 is disposed of.

There will be no order as to costs.
