K.B.K. Vasuki, J.—On consent, this writ petition is taken up for final hearing.

2.

The writ petition is filed for issuing appropriate direction to the fourth respondent/college authority to include the petitioner as one of the

members in the selection committee for admissions of students for UG and PG courses from the academic year 2010-2011.

3.

The petitioner herein admittedly possesses educational qualification as post graduation in Commerce and M.Phil. He was appointed as Lecturer

in Commerce in S.C. category in the fourth respondent institution on 13.07.2000. The petitioner herein, has come forward with this writ petition

seeking the relief as stated supra, on the strength of the guidelines issued by the Director of Collegiate Education approved by the Government in

G.O.ID. No. 88 dated 13.05.2010, regarding the procedure for admissions to UG and PG courses in Arts and Science Colleges for the academic

year 2010-2011. The approved guidelines and the approval of G.O.ID. No. 88 dated 13.05.2010 are enclosed at pages 9 to 20 and 7 of the

typed set of papers filed by the petitioner herein. The petitioner has making his present claim for his inclusion in the selection committee as per

Clause 7 of the guidelines so issued. The same is extracted hereunder:

7.

The Selection Committee shall consist of the Principal and two senior most Selection Grade Lecturers/Readers of the College. In addition, for

selection to the UG courses the senior most member of the teaching staff belonging to SC/ST of the college, if available, shall be co-opted and for

selection to the PG courses the senior most SC/ST staff from a Post Graduate Department shall be co-opted. If no such teacher is available, the

person co-opted for the UG selection committee shall also serve in the Post Graduate selection committee.

According to the learned Counsel for the petitioner, the petitioner is the only senior most teaching staff belonging to SC/ST of the college as such

he is bound to be included in the selection committee, as per Clause 7. It is further contended by him that despite his repeated representations

made to the college authority in this regard, his representations are purposely kept pending in order to avoid including the petitioner in the selection

committee.

4.

Heard the rival submissions made on both sides.

5.

Though the petitioner has claimed larger relief in this writ petition, this Court is of the considered view that it would be appropriate at this stage

to restrict the relief by directing the fourth respondent college authority to consider the latest representation made by the petitioner in this regard to

the fourth respondent in the light of the guidelines issued by the Government in G.O.ID. No. 88 dated 13.05.2010.

6.

In the result, the fourth respondent is directed to duly consider the claim of the petitioner for his inclusion in the selection committee for the

admission of students for UG and PG courses from the academic year 2010-2011 as made in his representation dated 24.05.2010, in the light of

the guidelines issued by the Government in G.O.ID. No. 88 Higher Education (G1) Department dated 13.05.2010 within four weeks from the

date of receipt of copy of this order.

7.

With this observation, this writ petition is disposed of. The connected miscellaneous petition is closed. No costs.
