Judgment

[1] Heard Mr. Kh. Tarunkumar, learned senior counsel assisted by Ms. Julekha Khan, learned counsel for the petitioner and Mr. B.P. Sahu, learned senior counsel assisted by Mr. D.P. Sahu, learned counsel for the respondents.
[2] By the present petition, the petitioner challenged the Advertisement No. 2/2025 dated 13-05-2025 issued by the Registrar i/c, Manipur University calling for application from various posts including the post of Junior Assistant. For Junior Assistant, 10 seats are notified out of which 6 are UR, 1 OBC and 3 ST.
[3] It is the case of the petitioner that she has, on earlier occasion, approached this Court seeking for regularization of her service in Manipur University. Vide order dated 21-10-2024 passed by this Court in WP(C) No. 739 of 2024 also filed by the present petitioner, the respondents were directed to consider the case of the petitioner for regularization along with the prayer for similarly situated persons. While the representation of the petitioner is pending and without considering the representation on merit, the respondents have issued an advertisement dated 13-05-2025 calling for recruitment of various posts including the posts of Junior Assistant. If the recruitment process is completed, then the representation submitted by the petitioner will become infructuous.
[4] Mr. Kh. Tarunkumar, learned senior counsel for the petitioner, submits that during the pendency of this petition and till the representation submitted by the petitioner is decided on merit by the MU, 1 seat out of 6 UR seats be kept apart.
[5] On the other hand, Mr. B.P. Sahu, learned senior counsel for the MU, submits that let the recruitment proceedings be proceeded and the result for one post of Junior Assistant (UR) may not be declared without the leave of this Court.
[6] Issue notice.
[7] Mr. D.P. Sahu, learned counsel, accepts notice on behalf of the respondents and prays for two weeks’ time for filing counter affidavit.
[8] In order to avoid any complicacy in future, respondents are permitted to proceed with the recruitment process in terms of the advertisement dated 13-05-2025 subject to the condition that one post of Junior Assistant (UR) be kept unfilled till the representation of the petitioner is decided by the respondents.
[9] List these cases before the roster Bench on 01-08-2025.
