O R D E R

The present petition is filed on 10.02.2023 under Section 9 of the Insolvency and Bankruptcy Code, 2016 (for brevity ‘IBC/ Code), r/w Rule 6 of the I & B (Application to Adjudicating Authority) Rules, 2016, by M/s. Transprofessionals Tours and Travels Private Limited (for brevity ‘Operational Creditor/Petitioner’) interalia seeking Corporate Insolvency Resolution Process against Katerra India Private Limited (hereinafter referred as ‘Corporate Debtor/Respondent) on the ground that the Corporate Debtor has committed a default for a total outstanding amount of Rs.1,14,27,420/- (Rupees One Crore Fourteen Lakhs Twenty Seven Thousand Four Hundred and Twenty only) as on 01.06.2021, in respect of Transportation services provided to the Corporate Debtor on a hiring basis.

Heard the Learned Counsel for the Petitioner and Learned Counsel for the Respondent and perused the records available.

The instant C.P bearing C.P (IB) No.68/BB/2023 was reserved for orders on 17.08.2023. In view of the order passed today i.e, 8th September 2023 by this Adjudicating Authority in another Company Petition bearing C.P(IB) No. 74/BB/2023 which is filed by Yes Bank Limited under Section 7 of the Insolvency and Bankruptcy Code, 2016 read with Rule 4 of the I & B (Application to Adjudicating Authority) Rules, 2016 against the same Corporate Debtor herein i.e., Katerra India Private Limited and since the Corporate Insolvency Resolution Process (CIRP) has been initiated in respect of the Corporate Debtor therein by appointing the IRP, the instant C.P is disposed of by granting liberty to the Petitioner herein to put-forth their claim before the IRP appointed in C.P (IB) No.74/BB/2023 in accordance with the provisions of the IBC 2016 and the Regulations made thereunder.

Accordingly, C.P (IB) No.68/BB/2023 is disposed of.
