Judgment
In this petition, petitioner seeks the following reliefs:
“a)Issue a writ of certiorari or any other writ of like nature and quash the work order dated 04.07.2026 bearing no. C1/ಸ.ಶಿ.ಕ/ಕೆ.ಜಿ.ಬಿ.ವಿ.ಟಿಪ್-4/ಆ.ಪೂ/13/2026-27 issued by the respondent no.4 to respondent no.5 vide Annexure-H to the writ petition,
b)Issue writ of mandamus or any other writ of like nature and direct the respondent no.4 consider this petitioner as the successful bidder and to issue work order and
c)Grant any other remedy that this Hon’ble Court deems fit in the facts and circumstances of the case”
A perusal of the material on record would indicate that on 11.06.2026, the respondent No.4 invited the subject tenders for supply of packaged goods to various residential schools in Kalaburagi District. The petitioner, respondent No.5 and Mahaboob Subhani Vividodesh Seva Sangh having submitted their respective bids among others, the petitioner, respondent No.5 and the said Mahaboob Subhani Vividodesh Seva Sangh were found to be eligible when their technical bids were opened and all three of them quoted the lower/equal bid amount of Rs.1,530/-. Subsequently, the tender of the respondent No.5 was accepted on 02.07.2026, pursuant to which respondent No.4 issued work order in favour of respondent No.5, in relation to the subject tender, awarding the work under the subject tender in favour of respondent No.5. Aggrieved by the impugned work order issued by respondent No.4 in favour of respondent No.5, the petitioner is before this Court by way of the present petition.
In addition to reiterating the various contentions urged in the petition and referring to the material on record, learned counsel for the petitioner invited my attention to the subject tender at page No.6, in order point out that in the event more than one bidder is found to be the least bidder (L1), the person who has had maximum financial turnover for the preceding 3 years and had experience in packaged food would be eligible. In this context, he would invite my attention to the certificate dated 17.06.2026 in order to contend that the annual turnover of the petitioner is for the preceding 3 years was Rs.88,22,83,987/- which was much more than Rs.59,38,63,415.66/- of the respondent No.5 and as such, the petitioner had more experience and higher turnover than the respondent No.5 for the purpose of being selected for the subject tender and the rejection of the bid of the petitioner and acceptance of the bid of the respondent No.5 is illegal, arbitrary and the same deserves to be quashed.
Per contra, learned counsel for respondent No.2 as well as learned counsel for the respondent No.5/successful bidder jointly reiterate the various contentions urged in their statement of objections and submit that in the light of the petitioner already having filed an appeal on 03.07.2026, the present petition is not maintainable and same is liable to be dismissed.

2026-27ನೇ ಸಾಲಿನ ಕೆ.ಜಿ.ಬಿ.ವಿ ಟ್ರಸ್ಟ ವಸತಿ ಶಾಲೆಗಳಿಗೆ ಸಿದ್ಧಪಡಿಸಿದ ಆಹಾರ ಪೂರೈಕೆ ಯೋಜನೆಯಡಿಯಲ್ಲಿ ರಾಜ್ಯ ಯೋಜನಾ ನಿರ್ದೇಶಕರು ಸಮಗ್ರ ಶಿಕ್ಷಣ ಕರ್ನಾಟಕ ಬೆಂಗಳೂರು ರವರ ಸುತ್ತೋಲೆ ಸಂಖ್ಯೆ: ಸಶಿಕ/ಕೆ.ಜಿ.ಬಿ.ವಿ/ಟಿಪ್-1 & 3/ಸುತ್ತೋಲೆ/2026-27 ದಿನಾಂಕ: 25.05.2026 ರನ್ವಯ 2026-27ನೇ ಸಾಲಿನ ಸಿದ್ಧಪಡಿಸಿದ ಆಹಾರ ಪೂರೈಕೆಗೆ ಟೆಂಡರ್ ಕರೆಯಲಾಗಿದೆ.
ಮುಂದುವರೆದು, ದಿನಾಂಕ: 11.06.2026 ರಂದು e-procurement ಮುಖಾಂತರ ಅಲ್ಪಾವಧಿ ಟೆಂಡರ್ ಜಾಹೀರಾತುಗಳನ್ನು ಪತ್ರಿಕಾ ಪ್ರಕಟಣೆಯ ಮೂಲಕ ಪ್ರಕಟಿಸಲಾಗಿದೆ. ಅದರಂತೆ ದಿನಾಂಕ: 19.06.2026 ರಂದು ಟೆಂಡರ್ ಸಲ್ಲಿಸಲು ಕೊನೆಯ ದಿನಾಂಕ: 19.06.2026 ಆಗಿದ್ದು, ಸದರಿ ಟೆಂಡರ್ ನಲ್ಲಿ ಒಟ್ಟು ಮೂರು ಜನ ಬಿಡ್ದಾರರು ಭಾಗವಹಿಸಿರುತ್ತಾರೆ.

ಅದರಂತೆ ದಿನಾಂಕ: 23.06.2026 ಉಪ ಕಾರ್ಯದರ್ಶಿಗಳು ಜಿಲ್ಲಾ ಪಂಚಾಯತ ಕಲಬುರಗಿ ಇವರ ಅಧ್ಯಕ್ಷತೆಯಲ್ಲಿ ನಡೆದ ತಾಂತ್ರಿಕ ಪರಿಶೀಲನಾ ಸಮಿತಿ ಸಭೆ ನಡೆಸಲಾಯಿತು. ಸಭೆಯಲ್ಲಿ ಈ ಕೆಳಕಂಡ ಸದಸ್ಯರು ಹಾಜರಾಗಿದ್ದರು.

4.ವಾಣಿಜ್ಯ ತೆರಿಗೆ ಇಲಾಖೆಯ ಅಧಿಕಾರಿಗಳು ಕಲಬುರಗಿ
5.ಉಪ ನಿರ್ದೇಶಕರು ಆಡಳಿತ ಶಾಲಾ ಶಿಕ್ಷಣ ಇಲಾಖೆ ಕಲಬುರಗಿ.

ಮೇಲ್ಕಂಡ ಸದಸ್ಯರ ಉಪಸ್ಥಿತಿಯಲ್ಲಿ ತಾಂತ್ರಿಕ ಬಿಡ್ ತೆರೆಯಲಾಯಿತು. ಸದರಿ ತಾಂತ್ರಿಕ ಬಿಡ್ ನಲ್ಲಿ ಮೂರು ಜನ ಭಾಗವಹಿಸಿದ್ದು, ಮೂರೂ ಜನ ಬಿಡ್ದಾರರು ಅರ್ಹರಾಗಿರುತ್ತಾರೆ.

ಮುಂದುವರೆದಂತೆ ತಾಂತ್ರಿಕ ಬಿಡ್ಡನ್ನು ಮಾನ್ಯ ಮುಖ್ಯ ಕಾರ್ಯನಿರ್ವಾಹಕ ಅಧಿಕಾರಿಗಳು ಜಿಲ್ಲಾ ಪಂಚಾಯತ ಕಲಬುರಗಿ ರವರು ದಿನಾಂಕ: 30.06.2026 ರಂದು ತಾಂತ್ರಿಕ ಬಿಡ್ ಒಪ್ಪಿಕೊಂಡು ಅನುಮೋದಿಸಿದರು.
ನಂತರ ಕಂಡಿಕೆ 17ರಲ್ಲಿ ತಿಳಿಸಿದಂತೆ ಆರ್ಥಿಕ ಬಿಡ್ ತೆರೆಯಲು ತಿಳಿಸಿರುತ್ತಾರೆ. ಆರ್ಥಿಕ ಬಿಡ್ದಲ್ಲಿರುವ ಷರತ್ತು ಮತ್ತು ನಿಬಂಧನೆಗಳಿಗೆ ಒಳಪಟ್ಟಂತೆ ಆರ್ಥಿಕ ಬಿಡ್ ತೆರೆಯಲಾಯಿತು. ಆರ್ಥಿಕ ಬಿಡ್ದಲ್ಲಿ ಮೂರು ಜನ ಬಿಡ್ದಾರರು ಒಂದೇ ದರವನ್ನು ನಮೂದಿಸಿ L-1 ಆಗಿರುತ್ತಾರೆ.
ರಾಜ್ಯ ಯೋಜನಾ ನಿರ್ದೇಶಕರು ಸಮಗ್ರ ಶಿಕ್ಷಣ ಕರ್ನಾಟಕ ಬೆಂಗಳೂರು ರವರ ಸುತ್ತೋಲೆ ದಿನಾಂಕ: 25.05.2026 ರಂತೆ ಕ್ರ.ಸಂ 01 ಷರತ್ತು ಮತ್ತು ನಿಬಂಧನೆಗಳಂತೆ ಒಂದು ವೇಳೆ ಆರ್ಥಿಕ ಬಿಡ್ನಲ್ಲಿ ಒಬ್ಬರಿಗಿಂತ ಹೆಚ್ಚು L-1 ಆಗದಲ್ಲಿ ಸಿದ್ಧಪಡಿಸಿದ ಆಹಾರ ಪೂರೈಕೆಯಲ್ಲಿ ಅತೀ ಹೆಚ್ಚು ವಾರ್ಷಿಕ ವಹಿವಾಟು ಹೊಂದಿರುವವರನ್ನು ಪರಿಗಣಿಸಲಾಗುವುದು ಎಂದು ಷರತ್ತು ಮತ್ತು ನಿಬಂಧನೆಯಲ್ಲಿರುತ್ತದೆ.
ಈಗಾಗಲೇ ನಮ್ಮ ಟೆಂಡರ್ ಪ್ರಕಟಣೆ ಷರತ್ತು ಮತ್ತು ನಿಬಂಧನೆಗಳು ಕ್ರ.ಸಂ 02 ರಲ್ಲಿ ತಿಳಿಸಿದಂತೆ ಆರ್ಥಿಕ ಬಿಡ್ನಲ್ಲಿ ಹೆಚ್ಚು L-1 ಆದಲ್ಲಿ ಸಿದ್ಧಪಡಿಸಿದ ಆಹಾರ ಪೂರೈಕೆಯಲ್ಲಿ ಅತೀ ಹೆಚ್ಚು ಆರ್ಥಿಕ ವಹಿವಾಟು ಹೊಂದಿರುವವರನ್ನು ಪರಿಗಣಿಸಲಾಗುವುದು ಎಂದು ತಿಳಿಸಲಾಗಿರುತ್ತದೆ.
ಮುಂದುವರೆದು, ದಿನಾಂಕ: 30.06.2026 ರಂದು ಆರ್ಥಿಕ ಬಿಡ್ನ್ನು ತೆರೆಯಲಾಗಿದ್ದು, ಮೂರು ಬಿಡ್ದಾರರ ಆರ್ಥಿಕ ಬಿಡ್ನ ವಿವರ ಈ ಕೆಳಗಿನಂತಿರುತ್ತದೆ.
ಕ್ರ.ಸಂ ಹೆಸರು ನಿಗದಿಪಡಿಸಿದ ಬಿಡ್ ಮೊತ್ತ ರೂ. (ಪ್ರತಿ ವಿದ್ಯಾರ್ಥಿಗೆ) ಬಿಡ್ ಮಾಡಿದ ಮೊತ್ತ ರೂ. (ಪ್ರತಿ ವಿದ್ಯಾರ್ಥಿಗೆ) ಷರಾ 1. Anilkumar 1700 1530 2. Abdul Rahim 1700 1530 3. Basavaraj Kallappa khadakabhanvi 1700 1530 ಈ ಮೇಲಿನ ಎಲ್ಲಾ ಬಿಡ್ದಾರರು ಒಂದೇ ದರವನ್ನು ನಮೂದಿಸಿರುತ್ತಾರೆ. ದಿನಾಂಕ: 25.05.2026 ರ ಸುತ್ತೋಲೆಯಲ್ಲಿನ ಷರತ್ತು (01) ರ ಪ್ರಕಾರ ಒಂದು ವೇಳೆ ಆರ್ಥಿಕ ಬಿಡ್ನಲ್ಲಿ ಒಬ್ಬರಿಗಿಂತ ಹೆಚ್ಚಿನವರು L-1 ಆಗಿದ್ದಲ್ಲಿ ಅತೀ ಹೆಚ್ಚು ವಾರ್ಷಿಕ ವಹಿವಾಟು ಹೊಂದಿರುವವರನ್ನು ಪರಿಗಣಿಸಬೇಕು ಎಂದು ಷರತ್ತು ನೀಡಿರುತ್ತಾರೆ, ಬಿಡ್ದಾರರ ಆರ್ಥಿಕ ವಹಿವಾಟು ಇರುತ್ತದೆ.
ಮುಂದುವರೆದಂತೆ, ಟೆಂಡರ್ ನಲ್ಲಿ ಆರ್ಥಿಕ ವಹಿವಾಟು ಎಂದರೆ ಬಿಡ್ದಾರರ 2023-24, 2024-25 ಮತ್ತು 2025-26 ರಲ್ಲಿ ಆರ್ಥಿಕ ವಹಿವಾಟು ವಿಶ್ಲೇಷಣೆ ಎಂದರೆ ಸಿದ್ಧಪಡಿಸಿದ ಆಹಾರವನ್ನು ಪೂರೈಸಿದ Profit and loss, Receipt and payment, Income and expenditure ಸದರಿಯವರ ವಹಿವಾಟು ಈ ಕೆಳಗಿನಂತಿರುತ್ತದೆ.

By way of reply, learned counsel for the petitioner on instructions submits that the present petition may be disposed of directing the respondent No.1/appellate authority to dispose of the appeal filed by the petitioner on 03.07.2026 as expeditiously as possible.
In view of the aforesaid fact and circumstances and the undisputed fact that the bid of the respondent No.5 was accepted by respondent No.4 on 02.07.2026, pursuant to which the petitioner filed an appeal on 03.07.2026, as can be seen from the acknowledgment at Annexure-G dated 03.07.2026, without expressing any opinion on the merits/demerits of the rival contentions, since the said appeal filed by the petitioner is still pending adjudication, the respondent No.1/appellate authority is hereby directed to dispose of the appeal in accordance with law within a period of one (1) month from the date of receipt of a copy of this order.
Subject to aforesaid directions, the petition stands disposed of.
