IA/4699/2021:-

By filing this application, the applicant/IRP has prayed to withdraw the Company Petition IB/1009/ND/2020.

Heard. Ld. Counsel for the IRP as well as IRP who has appeared in person, and perused the averments made in the application.

Ld. Counsel for the IRP submits that he has received Form FA, enclosed at page 30 of the applications, in terms of settlement arrived in between the operational Creditor and the Corporate Debtor.

He further submits that the IRP has not received any claim from anyone in terms of the public announcement. He further submits that the IRP has received his fee and expenses. He further submits that the CoC has not been constituted as yet.

Considering these submissions, since the matter is settled between the Operational Creditor and Corporate Debtor and the Form FA is duly signed by the applicant, at page 30 .And as per the averments made in para 7 of the affidavit filed by the IRP, no claim has been received. Therefore, we permit the applicant to withdraw the application i.e. Company Petition IB/1009/ND/2020.

Accordingly the IB/1009/ND/2020 is dismissed as withdrawn.

With this present application stands disposed of.
