Judgment
ORDER
Heard the submissions made by Ld. Counsels appearing for the Operational Creditor, RP and Corporate Debtor. It has been brought to our notice that vide order dated 18.07.2023 in IB/139/ND/2023 in the matter of Euphoria Construction Pvt. Ltd. Vs. Aarcity Infrastructure Pvt. Ltd. CIRP was initiated against the present Corporate Debtor i.e. M/s. Aarcity Infrastructure Pvt. Ltd. In view of the same position, we direct the present Operational Creditor to file its claim before the IRP appointed in IB/139/ND/2023 since vide order dated 01.11.2022 passed in the present matter. The payment of Rs. 6,00,000/- has been paid by the Corporate Debtor towards the CIRP cost and Ld. Counsel appearing for the Corporate Debtor confirmed that said payment has been made. In view of the said position the present Operational Creditor is at liberty to file claim before the IRP appointed in IB/139/ND/2023 vide order dated 18.07.2023. Therefore, IB/2185/ND/2019 stands dismissed being infructuous.
