ORDER
IA No. 2534/2020: Application filed by IRP Mr. Rajesh Kumar Goyal under Section 12A seeking withdrawal of the main IB application for initiation of CIRP. Learned counsel for the IRP says that the order of CIRP initiation was passed by this Bench on 05.03.2020 and the parties have arrived at a settlement. IRP states that COC is not formed and the only claim received by IRP is of the Operational Creditor. In view of the settlement arrived between the parties through memorandum of understanding dated 23.06.2020, the parties seek to withdraw the insolvency application. Learned counsel for the IRP Mr. Rajesh Kumar Goyal makes a statement that fees of IRP and cost are paid and no assets/documents were received from the Corporate Debtor. In view of the same, we allow IA No. 365/2019 and further order that IRP Mr. Rajesh Kumar Goyal is discharged forthwith as IRP of the Corporate Debtor. Application is allowed, thereby IB-365/2019 stands withdrawn and disposed of.
