Judgment
Pursuant to the earlier order dated 21.01.2020, IRP has filed an affidavit stating the facts that in response to the publication, no claim has been received, even till today no claim has been received and neither CoC has been constituted as yet.
Heard the Ld. Counsel IRP and perused the averments made in the application. Since, neither claim has been received nor the CoC has been constituted and the present application has filed by the IRP in terms of settlement arrived between the parties; therefore, in view of Section 12(A) of the IBCread with Regulation 30(A) of the IBBI (Insolvency Resolution Process for Corporate Persons) Regulations, 2016, we hereby permit the IRP to withdraw the same. Accordingly, the main application stands dismissed as withdrawn.
