Learned counsel for R1 & R2 are present.

When the matter is taken up, learned counsel for the petitioner submitted that the petitioner filed Writ petition against the order dated 25.11.2025 passed by this Tribunal in the waiver application - IA 889/2025 and the matter is listed before the learned Registrar of the Hon’ble High Court of Karnataka and thus, he seeks adjournment. The order in the waiver application was passed on 25.11.2025 and posted for compliance on 26.12.2025. Since there was no sitting on 26.12.2025, it was adjourned to today and taken up today. Despite there being nearly 2 months available to get the orders from the Hon’ble High Court of Karnataka, the petitioner has not obtained any order.

Therefore, merely, on the submission that writ petition had been filed against the order passed by this Tribunal in the waiver application and when there being no order against the order passed in the waiver application, further adjournment cannot be given. Admittedly, conditional order passed in the waiver application is not complied with. Therefore, the waiver application in IA 889/2025 is dismissed for non compliance of the order dated 25.11.2026 resulting in rejection of the appeal in AIR (SA) 1173/2025.
