This hearing has been conducted through hybrid mode.
The present petition has been filed by the petitioner under Article 227 of the constitution of India, 1950, assailing the impugned order dated 29th August, 2022, passed by the learned Trial Court in Civil Suit No. 881/2017, whereby an application of the petitioner under Order IX Rule 7 of Code of Civil Procedure, 1908 for setting aside ex-parte order dated 11th January, 2021 has been dismissed.
Heard. Record perused.
At the outset, learned Counsel for the respondent submits that the respondent has no objection if the impugned ex-parte order dated 11th January, 2021 is set aside, subject to payment of exemplary costs.
In view of this submission made by the learned Counsel for the respondent, the impugned ex-parte order dated 11th January, 2021 is set aside subject to a payment of costs of Rs. 15,000/- to the respondent, and consequent thereto, the petitioner is also granted two weeks’ time from today to file the written statement before the learned Trial Court to avoid any further delay in the disposal of the matter.
Accordingly, the petition is disposed of in the above-stated terms. Pending application(s), if any, also stand disposed of.
