The present writ petition has been filed under Article 226 of the Constitution of India with the following prayers: -

“(i) Issue a writ, order in the nature of mandamus directing the respondent to take a decision on the application/ representation dated 19.12.2024 submitted by the petitioner (contained in annexure no. 5 to this writ petition).

(ii) Issue any other or further writ, order or direction which this Hon’ble Court may deem fit and proper in the circumstances of the case.

(iii) Award the cost of the petition in favour of the petitioner.”

Heard Mr. Rajesh Chandra Kandpal, learned counsel for the petitioner and Mr. Ashish Joshi, learned counsel for the respondents.

Mr. Ashish Joshi, Advocate, on instruct ion, submitted that the representation dated 19.12.2024, filed by the petitioner, has already been rejected on 10.02.2025. However, he has submitted that the petitioner may move a fresh representation for OTS and in case the petitioner moves its representation within one week, the competent authority shall decide the said representation within ten days thereafter.

Learned counsel for the petitioner agrees with the said proposal.

With the consent of the learned counsel for both the parties and in view of the order dated 10.02.2025, the present writ petition is disposed of with a direct ion that in case the petitioner moves a fresh representation along with a certified copy of this order within one week from today for OTS, the competent authority shall consider and decide the same within ten days thereafter.

It is made clear that this Court has not expressed any opinion on the merit of the case.
