Judgment
ORDER
This appeal is filed against the interim order passed in IA 373/2025 in SA 63/202 by the learned Presiding Officer, DRT-II, Ernakulam.
SA 63/2025 was filed to set aside and quash both the Annexure-A1 Order and Annexure A-2 notice and in the said SA, IA 373/2025 is filed for staying the order passed in Annexure-I in MC 1039/2024 by the learned Chief Judicial Magistrate Thiruvananthapuran and Annexure-2 notice issued by the learned Advocate Commissioner. On dismissal of the stay application, this appeal is filed. SA 63/2025 is still pending. The grounds raised in the SA 63/2025 have to considered only by the learned Presiding Officer, DRT-II, Ernakulam.
Therefore, this Tribunal is of the view that a direction has to be given to the learned Presiding Officer, DRT-II, Ernakulam to dispose the SA 63/2025 as expeditiously as possible. While entertaining this appeal, this Tribunal ordered the parties to maintain Status Quo as on 23.12.2025 with regard to possession of secured asset and the said order is to be continued for a period of two months from today. The learned Presiding Officer, DRT-II, Ernakulam is directed to make endeavour to dispose the SA 63/2025 within a period of two months, if not, then it is for the learned Presiding Officer, DRT-II, Ernakulam to continue or discontinue the order of Status Quo depending on the need and exigency. This Tribunal has also passed an order on 26.02.2026 with regard to installation of CCTV camaras. It is informed that as ordered by this Tribunal in IA 259/2026, CCTV Camaras have been installed. That CCTV camaras shall be kept in operational by both parties to avoid unnecessary disputes and complications in future. This appeal is disposed accordingly. Parties are directed to bear their own costs. Pending IAs, if any shall stand closed.
