ORDER
CA 1623/2019 which is filed under Section 33 (2) of the Code by the RP is pressed for disposal be disposed off. Ld. Counsel has submitted that the resolution to move for liquidation was taken in the meeting held on 19th October 2019. The matter was put to vote and was duly approved by the Ford Credit which holds more than 90% in terms of the voting power.
Mr. R. Soundara Rajan, Ld. Counsel appearing for Ford Credit Private Limited, which is a major Financial Creditor, submits that they have not finalised the name of any Liquidator appointed in this case and leave it to the discretion of this Bench to appoint one.
Accordingly, we appoint Ms. Preeti Jaiswal, IBBI/IPA-001/IP-P00523/2017-2018/10948, Email ID:[email protected]; Mobile:9310746002; as the RP to act as a Liquidator in this case. The consent of the proposed Liquidator be procured by the RP within 1 week from today.
CA 1094/2019 – Ld. Counsel appearing for the RP submits that the claim in CA 1094/2019 has been addressed and therefore the CA has become infructuous.
CA 1094/2019 stands disposed off.
Vide CA 1095/2019 has been filed against the Ex-Directors for non-coopertion. NBW have also been issued against Mr. Girish Bhatia. Mr. Manish Jain, Ld. Counsel however appears on his behalf today. He submits that he shall be filing an appropriate application for recall and reply to CA 1095/2019.
