This is an application has been filed by the Operational Creditor

viz. Riddhi Siddhi Cotex Private Limited against the Corporate Debtor viz.

Sri Lakshmi Saraswathi Impeex (India) Limited under Section 9 of the Insolvency and Bankruptcy Code, 2016 (hereinafter referred to as 'IBC', 2016) seeking thereof to initiate Corporate Insolvency Resolution Process as against the Corporate Debtor.

In the present Application, the Operational Creditor, as on 26.09.2019 has claimed a sum of Rs.2,77,877/- (Rupees Two Lakhs Seventy-Seven Thousand Eight Hundred and Seventy-Seven only), as due and payable by the Corporate Debtor.

Heard Learned Counsel for the Operational Creditor and perused the documents filed by the parties.

An Application filed under Section 9 of the I&B Code, 2016 by a Operational Creditor in IBA/1189/2019 has been admitted by this Authority vide Order dated 25.09.2023 and Corporate Insolvency Resolution Process (CIRP) has been initiated against the Corporate Debtor and one MRS. S. THAMILVANI WITH REG. NO. IBBI/IPA-001/IPP00827/2017-2018/11412 (EMAIL ID:- [email protected])

has been appointed as Interim Resolution Professional (IRP). Under the circumstances, we direct the Operational Creditor to lodge the claim as made in this Application before the said IRP within the time limit as specified under the provisions of the I&B Code, 2016, and upon lodging the claim by the Operational Creditor, the IRP to consider the claim on merits and in accordance with the I&B Code, 2016 and other applicable laws, if any.

With the above directions, this Application stands closed.
