2.

The writ petition has been filed with the following prayer:-

“(a)

Direct Respondents to rectify the technical glitch relating to non-recognition of the Petitioner's DSC and FIPS 3.0 tokens within a time-bound schedule, and proceed with the upcoming tender only after ensuring proper functioning of the e-procurement portal.

(b)

direct Respondent No. 2 to consider and decide, by a reasoned and speaking order within such time as this Hon'ble Court may fix, the Petitioner's representation dated 08.10.2026

(c)

direct that the EMD of Rs. 3,45,210/- paid on 23.09.2026 be adjusted in the fresh / re-opened tender or, at the Petitioner's option, be refunded in full, and that it shall not be forfeited;

(F)

direct the respondents to put in place an alternative mode of submission, OR refrain respondents from proceeding with the upcoming tender process until the technical glitches duly rectified and the proper functioning of the e-procurement portal is ensured.

(h)

(i)

grant such other and further relief as this Hon'ble Court may deem just and proper in the facts and circumstances of the case.”

3.

Learned counsel for the petitioner submits that the main grievance in the present writ petition was that the digital signature of the petitioner was not recognized. He further submits that, at present, the same has been recognized and the tender papers have already been opened. Hence, he submits that the writ petition has become infructuous.

4.

Mr. Thakur, learned Additional Advocate General for respondents/State and Mr. Kesharwani, learned counsel for respondent No. 6, also acknowledge the same.

5.

Accordingly, the writ petition is disposed of as infructuous.
