PER ANUBHAV SHARMA, JM:

This appeal is preferred by the Assessee against the order dated 24.03.2026 of the Commissioner of Income-tax, Exemption, Delhi (hereinafter referred as ‘Competent Authority’) against the rejection of Form 10AB for grant of registration under Section 12A(1)(ac)(ii) of the Act.

2.

On hearing both sides we find that the impugned order has been passed primarily for the reason alleging non-compliance on the part of the assesse to a notice dated 12.03.2026 by which assesse was required to justify its activities were not commercial in nature. Ld. Counsel has pointed out on the basis of voluminous paper book that all material evidences were filed. There is a copy of notice available in paper book which shows that though notice was issued, however, there was no sufficient time to respond.

3.

In the light of aforesaid facts and circumstances we are inclined to restore the issue on merits to the files of ld. CIT(E) with a direction to give fresh opportunity of hearing and pass order afresh. The appeal is allowed for statistical purposes.
