Learned Counsel for the respondent submits that the amount covered by the impugned judgment and decree stands paid to the appellant in execution proceedings and that, therefore, the appeal has been rendered infructuous.

We note that there is no appearance on behalf of the appellant on 23 February 2026, 10 March 2026 and on 13 April 2026.

None appears for the appellant today either.

It appears that the appellant is not appearing as the dispute stands settled.

In view of the statement made by the learned Counsel for the respondent, therefore, it does not appear that any lis survive for adjudication in the present appeal which is accordingly disposed of.
