PER RENU JAUHRI, AM:

An application has been filed on 13th May, 2026 for withdrawal of appeal by the assessee which was filed against the order of learned CIT(A), NFAC, New Delhi dated 17th April, 2026 for the assessment year 2012-13.

2.

None appeared on behalf of the assessee at the time of hearing. The assessee has filed a letter requesting for the withdrawal of the present appeal filed by it stating that the same was filed due to a bona-fide and inadvertent error on the part of the assessee during the e-filing process on the ITAT portal. However, the same was rectified promptly and another fresh appeal was filed, and this fact was brought to the notice of the Registry of the Tribunal vide email dated 13th May, 2026. The correct appeal has been registered as ITA No.5369/Del/2026 for the assessment year under consideration. It has, therefore, been requested to permit the assessee to withdraw the present appeal being ITA No.5370/Del/2026.

3.

Learned Senior DR has no objection.

4.

After considering the submission of the assessee and perusal of record, we allow the request of the assessee to withdraw the present appeal filed by it due to an inadvertent error and dismiss the same.

5.

In the result, the appeal filed by the assessee is dismissed as withdrawn.
