Learned Counsel for the Financial Creditor is present. It is seen from the order dated 17.05.2022 passed in the matter of IB-690/ND/2019 that the present Corporate Debtor i.e., M/s. Unilec Engineer Limited has already been put under the CIRP in terms of Section 9 of the IBC. In the said case Mr. Tarachand Sharma, Insolvency Professional having registration No.IBBI/IPA-002/IP-N00218/2017-18/10670 has already appointed by this Tribunal as Interim Resolution Professional.
Counsel for the Financial Creditor is directed to file appropriate claim of his client before the said IRP for due consideration in the CIRP proceedings of the Corporate Debtor i.e., M/s. Unilec Engineer Limited. However, liberty is granted to Financial Creditor to revive the present petition i.e., IB-107(ND)/2022 in case the order dated 17.05.2022 passed in the IB-690/ND/2019 is set aside by the Appellate Courts or the said Corporate Debtor enters into any type of settlement with the Financial Creditor in the matter i.e., IB-690/ND/2019.
In view of the above, the present petition i.e., IB-107(ND)/2022 is disposed of.
