Judgment
Learned counsel for the appellant submits that the present appeal is filed against an interlocutory order, by which the right of the appellants to file written statement to the original application has been closed. It is further submitted that the written statement was not filed due to illegible copy of the documents supplied by the respondent-Bank. It is also submitted that the original application filed by the appellant is still pending consideration, therefore, the matter may be remanded back with liberty to the appellant for filing written statement.
Learned counsel for the respondent-Bank has no objection to the prayer made by the learned counsel for the appellant, but the Tribunal may be directed to decide the original application, which is still pending consideration, within the time as framed by this Tribunal.
In view of the submissions made by the learned counsels for both the parties, the order impugned is set aside and the appeal filed by the appellants stands disposed of with liberty to the appellant for filing written statement to the OA of the respondent-Bank within 10 days from today. Since the OA pertains to the year 2019, therefore, the Tribunal below is directed to decide the Original Application in accordance with law most expeditiously, preferably within three months from the date of filing of the written statement by the appellants. In case, the written statement is not filed by the appellants within the time as stipulated above, the right of the appellants to file written statement shall stand closed.
