The Learned Counsel for the Appellants would submit that previously he was appearing for the Appellants. However, he has returned the brief to the Appellants so that they may appoint another Counsel. Therefore, he prays to be discharged.

The Learned Counsel for Respondent No.1 would submit that as per order dated 27.02.2026, the Appellants were directed to make the mandatory pre-deposit of 40% of ₹2,05,00,000/- in four installments and the last installment of ₹20,50,000/- was to be paid on 24.04.2026. He would further submit that in paragraph 8 of the order dated 27.02.2026, it was specifically stated that in case of default in depositing any installment of pre-deposit as per section 18 of SARFAESI Act, within the stipulated time, the Appeal shall stand dismissed automatically without further reference to this Appellate Tribunal. He would further submit that the proviso to Section 18 specifically states that no Appeal can be entertained without the mandatory pre-deposit as required under Section 18 of the SARFAESI Act.

In view of the above this Misc. Appeal Diary No. 1965/2025 is dismissed.
