C.P.(IB)No.237/BB/2019 is filed by M/s.Jcdecaux Advertising India Private Limited (Petitioner) U/s 9 of IBC, 2016, R/w Rule 4 of Insolvency and Bankruptcy (Application to Adjudicating Authority) Rules, 2016, by inter-alia seeking to initiate Corporate Insolvency Resolution Process (CIRP) in respect of M/s.Skylark Arcadia Private Limited, (Respondent/Corporate Debtor) on the ground that the Corporate Debtor committed a default in payment of Rs.30,12,692/- (Rupees Thirty Lakh Twelve thousand Six Hundred Ninety Two Only).

The case is listed for hearing on various dates viz., 02.07.2019, 15.07.2019, 16.07.2019, 30.07.2019, 09.08.2019, 16.08.2019 & 29.08.2019. On 16.08.2019 and 29.09.2019, neither the Petitioner nor Counsel for the Petitioner appeared before the Tribunal.

Therefore, the case was posted under the caption “For Dismissal” on 29.08.2019. Today also none appeared for the Petitioner. Therefore, it indicates that the Petitioner are not interested to prosecute the case and thus there is no other alternative for the Tribunal except to dismiss the case for default for non-prosecution.

Hence, C.P(IB) No.237/BB/2019 is dismissed for default for non-prosecution of the case. No order as to costs.
