Judgment
This is an application under Section 12A of the IBC, 2016 read with Regulation 30A of the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) Regulations, 2016 and Rule 11 of the NCLT Rules, 2016 filed by Ms. Pratibha Khandelwal, IRP seeking withdrawal of CP No. (IB)- 48/9/JPR/2019. It is stated in the application that Applicant/IRP received a Settlement Deed dated 22.04.2023 along with the copy of the Form FA, whereby it was informed that the parties (Operational Creditor and the Corporate Debtor) have settled the matter and entire claim amount has been paid. Copy of the Settlement Deed has been attached with the Application as Annexure
A-1. It is also stated by IRP that she has received Rs. 2 lakhs as IRP fees. Ms. Pragya Anand, Proxy Counsel appearing on behalf of Ms. Charu Sangwan, Adv. for the Applicant submits that the application may be allowed. Permission granted. CP No. (IB)- 48/9/JPR/2019 is dismissed as withdrawn.
