Judgment
Counsel for the Operational Creditor is present and submits that in compliance of the order dated 18.02.2022 he has filed an affidavit in terms of Section 9 (3)(b) and 9 (3)(c) of the IBC as directed. Further in support of the petition being served upon the Corporate Debtor, affidavit in terms of Section 65B filed on 15.03.2022. The Court Officer, as directed, has also sent a Court notice to the said Corporate Debtor on 24.02.2022.
It is clear that the Corporate Debtor has been duly served with a copy of the present petition as well as due intimation has been given by the Court Officer about the proceedings pending before this Tribunal to the Corporate Debtor. Today, despite the aforesaid compliance there is no representation from the side of the Corporate Debtor. The service of the present petition is held proper and sufficient for further proceedings in the matter. Accordingly, the Corporate Debtor is set ex-parte for all future proceedings. List the matter for making final submissions by the Operational Creditor on 21.07.2022.
