Judgment

Heard the learned counsel for the parties.
This contempt petition is filed seeking to initiate contempt proceedings against the accused for disobedience of the order dated 31.01.2024 passed by this Court in Writ Petition No.2705/2024. The learned counsel submits that by the order of 31.01.2024, this Court had stayed the proceedings pursuant to the impugned tender notification dated 14.12.2023, but respondent No.2 has issued a fresh tender document for supply of the very same item that were part of the previous tender document.
It is stated that it is the tender document at Annexure - H, further proceedings in which have been stayed by this Court. The contention is that thereafter, vide Annexure - B2 dated 12.11.2024 a supply order has been issued privately to one Urdhva Management Private Limited for supply of the very same products.
In our opinion, in case the complainant was aggrieved by the supply order dated 12.11.2024, it was for the complainant to take appropriate steps. However, issuance of the supply order would not amount to disobedience of the order dated 31.01.2024 which had stayed proceedings pursuant to the tender notification dated 14.12.2023.
It is noted that the learned counsel for the parties are not at issue that the Writ Petition in which the aforesaid interim order dated 31.01.2024 was passed, is still pending. This contempt petition is therefore consigned.
