M/S Chabbras Associates vs M/S HSCC (India) Limited & Anr.

The instant petition has been filed under Sections 29A(4) and 29A(5) of the Arbitration and Conciliation Act, 1996^{11.O.M.P.(MISC.)(COMM.) 505/2026 Page 1 of 2} seeking extension of the mandate of the learned Sole Arbitrator, Hon’ble Mr. Justice Vipin Sanghi, Former Chief Justice of the Uttarakhand High Court, appointed by this Court vide order dated 14.02.2024.

Learned Counsel for the Petitioner submits that the petition was delayed on account of demise of the Petitioner’s General Power of Attorney Holder and the subsequent serious medical condition of its authorised representative. It is further submitted that the proceedings are at the stage of final arguments.

Learned Counsel for the Respondents submit that he has no objection to the extension of the mandate of the learned Sole Arbitrator.

It is well settled that the jurisdiction of the Court under Section 29A of the Act extends to enlarging the mandate of an arbitral tribunal even after expiry of its mandate, upon sufficient cause being shown.

In the present case, this Court is satisfied that sufficient cause has been established.

Accordingly, the mandate of the learned Sole Arbitrator is extended for a further period of 6 months w.e.f. 30.06.2026. The period commencing from 30.06.2026 till the date of the present order is also regularised.

The petition stands disposed of in the above terms.
