Judgment
PER SHRI L. N. GUPTA, MEMBER (T)
The present Application has been preferred by Sh. Anil Bhatia, Interim Resolution Professional, under Section 22(3)(a) of IBC 2016, for confirming his appointment as Resolution Professional of M/s Alliance Lumiere Ltd.
That the CIR process against the Corporate Debtor namely, M/s Alliance Lumiere Ltd. was initiated vide Order dated 05.09.2019 passed by this Tribunal.
It is submitted by the Ld. IRP that he had made the Public Announcement in the Newspaper on 20.09.2019 inviting claims as per provisions of IBC, 2016.
He has further submitted that CoC has been constituted comprising of S.R. Batliboi & Associates LLP, VKC & Associates and Chandwani & Chandwani as the Members of the CoC.
That the Ld. RP has placed the minutes of the first meeting of CoC held on 17.10.2019 on record, wherein, the following resolution has been passed by the CoC with (100%) voting :
" RESOLVED THAT Mr. Anil Bhatia, an Insolvency Professional (IP Reg. No. IBBI/IPA-001/IP-P00587/2017-18/11027) who was appointed as Interim Resolution Professional (IRP) be and is hereby appointed as the Resolution Professional (RP) in the matter of Corporate Insolvency Resolution Process of Alliance Lumiere Limited in accordance with provisions of Section 22(3)(a) of the Insolvency and Bankruptcy Code 2016".
That, the Ld. IRP Sh. Anil Bhatia has also filed his consent in Form AA, along with a copy of his IBBI Registration Certificate.
In view of the above, this Bench confirms the appointment of Sh. Anil Bhatia as Resolution Professional of M/s. Alliance Lumiere Ltd.
The Ld. RP is directed to take further steps in accordance with provisions of law.
The Application is allowed accordingly.
