Heard the submissions made by Learned Counsel for the Operational-creditor.
Application under Section 12A of the IBC, 2016 read with Regulation 30 A of IBBI Regulations 2016 read with rule 11 of the NCLT Rules 2016 seeking withdrawal of the application filed under Section 9 of the IBC is allowed for the reasons stated in the said application. We have also heard IRP in the matter and the matter is dismissed as withdrawn. In view of the above the company is free from IRP process under the IBC.
