Judgment
The petitioner who is a Bill clerk in the Tamil Nadu Civil Supplies Corporation has filed the present writ petition seeking to challenge the order of suspension, dated 23.04.2010 which was affected on account of the enquiry into grave charges against the petitioner was contemplated. In the meanwhile, the petitioner has moved the criminal Court since the criminal proceedings pending against him and obtained anticipatory bail. It is on the strength of the same, he has chosen to challenge the order of suspension.
When the matter came up on 02.07.2010, notice of motion was ordered. Pending notice of motion, no interim order was passed. Today, when the matter came up for hearing, learned counsel for the petitioner produced a typeset containing a final order against the petitioner, dated 07.01.2001 in which he was imposed with a penalty of postponement of increment for a period of two years with cumulative effect. It was also stated that it is prejudice to the criminal investigation pending against him he was given liberty to file an appeal to the appellate authority namely, the Managing Director of the Corporation. It is claimed that the petitioner has filed an appeal which is also pending.
In the meanwhile, learned counsel also produced a copy of the proceedings issued by the Senior Regional Manager reinstated the petitioner to service.
In the light of the subsequent development, there is no case made out to entertain the writ petition against the suspension order. Accordingly, the writ petition is dismissed as infructuous.
Learned counsel for the petitioner contended that the petitioner has to be paid salary for the relevant period. That question do not arise out of this writ petition. It is always open to him to make representation, if any dues are payable by the Corporation. No costs. Consequently, connected miscellaneous petition is closed.
