Judgment
Birendra Kumar, J
On 30.01.2024, this Court had passed following orders:-
“Let the signatories to the compromise application appear before the Deputy Registrar in person for verification of the compromise application.
Let the matter be placed before the Deputy Registrar on 06.02.2024.”
Respondent No. 3 has filed an application for recall of the said order.
It has been informed that the said order has already been complied, the parties who have entered into compromise have already appeared before the Deputy Registrar for verification of their signature and the same has already been verified.
Learned counsel for Respondent no. 3 contends that he is the main contesting party. He had appeared before the Deputy Registrar and raised objection that the compromise cannot be accepted.
Parties are free to settle their dispute and enter into compromise, hence, the compromise petition filed by the signatories who are parties to this appeal is accepted, however, it shall not bind respondent no. 3.
After compromise, learned counsel for the appellant seeks permission to withdraw this appeal. Prayer for withdrawal is allowed.
However, it is made clear that the compromise shall not bind respondent no. 3 who is not a signatory to the compromise petition. Respondent no. 3 would have liberty to pursue appropriate legal remedy.
Accordingly, this first appeal stands disposed off as withdrawn.
