While issuing notice of motion on 15.02.2018, arrest of the petitioner was stayed till the next date of hearing i.e. 01.03.2018.

Learned State Counsel on instructions from HC Balbir Singh states that though there was no such direction to join the petitioner in the investigation,

but the Investigating Officer has joined the petitioner in the investigation. During course of investigation, offence under Section 473 IPC has also

been added on the allegation that petitioner has forged number plate of the vehicle so as to transport the liquor in question.

Since the petitioner has already been allowed by the Investigating Officer to join the investigation and recovery has already been effected, therefore,

his custody is no more required in any further investigation of the case. Report under Section 173 Cr.P.C is almost complete and is ready to be filed

in the Court.

In view of aforesaid, petition is allowed and petitioner is directed to be released on anticipatory bail on his furnishing adequate bail bonds and surety

bonds to the satisfaction of the Investigating Officer subject to the following conditions:-

That he shall make himself available for interrogation by a police officer as and when required;

That he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade

him from disclosing such facts to the Court or to any police officer and;

That he shall not leave India without prior permission of the Court.
