The petitioners seek a writ in the nature of mandamus for issuing directions to respondent Nos. 1 to 3 to protect the life and personal liberty of the petitioners with a further prayer to direct respondent Nos. 4 and 5 not to allow/let anybody else to interfere with the liberty and life of the petitioner or to harras in any manner or to cause any detriment to the petitioners in any manner.

The learned counsel for the petitioners submit that this is the first marriage between the petitioners.

The petitioners have prayed for issuance of necessary directions to the official respondents for protecting their civil/personal rights and liberties from being invaded by the private respondents. Petitioners are alleged to have solemnized marriage on 18.06.2023 on attaining the age of majority. They feel reasonable apprehension and a threat perception at the hands of the private respondents and pray that their personal/civil rights be not violated by them.

Precisely, in the context of aforesaid relief, petitioners have approached the Senior Superintendent of Police, Fatehgarh Sahib-respondent No.2 by way of representation dated 19.06.2023 (Annexure P-5).

Notice of motion to respondent Nos.1 to 3.

On the asking of the Court, Mr. Anmol Singh Sandhu, AAG, Punjab, accepts notice on behalf of respondent Nos.1 to 3.

At this stage, without expressing any opinion as to the validity of marriage and majority of the petitioners, it would be just and appropriate to direct respondent No. 2 to look into the grievance of the petitioners and pass an appropriate order on merits in accordance with law. Till then, protect the life and liberty of the petitioners. Respondent No.2 would pass necessary order without being influenced by any pleadings made in the petition.

This order shall not debar the official respondents from proceeding against any of the parties, if they are involved in any other case. It would be appreciated if the needful is done within a period of one month from the date of receipt of certified copy of this order.

Petition stands disposed of accordingly.
