ORDER

When the matter is taken up, Learned Counsel for Petitioner/Appellant submitted that OP (DRT) No. 104/2025 was disposed of by Hon’ble High Court of Kerala on 25.02.2026 by granting time till 25.03.2026 to make the payment. A Memo to that effect is filed.

It is further submitted by Learned Counsel for Petitioner/Appellant that the Petitioner/Appellant filed IA 01/2026 in OP (DRT) No. 104/2025 for extension of time to make the payment of pre deposit, and thus, required an adjournment.

This Tribunal passed an order in Waiver Application on 26.02.2025. It is exactly one year and one month since the order was passed in the Waiver Application. However, the Petitioner/Appellant has neither complied with the order of this Appellate Tribunal nor the order of Hon’ble High Court of Kerala in OP (DRT) No. 104/2025. It is only stated that an Application for extension of time has been filed in IA 01/2026. However, no order passed in the said Application is produced before this Tribunal. In the said circumstances, this Tribunal dismisses IA 411/2022, Waiver Application for non-compliance of the directions of the Hon’ble High Court in OP (DRT) No. 104/2025 to make the pre deposit on or before 25.03.2026. Consequently, the Appeal in A.IR:298/2022is rejected. All pending IAs, if any, stand closed.
