Judgment
V. Jagannathan, J.—Heard both sides in respect of anticipatory bail sought by the Petitioner, who is involved in Crime No. 174/2010 registered for the offences punishable under Sections 324, 504, 506 and 306 of the I.P.C.
The case of the prosecution, in short, is that the mother of deceased Nanjundaswamy lodged a complaint stating that her son was working under the Petitioner for two years and when the deceased refused to go for work, the Petitioner is said to have abused him and also assaulted him on 27.11.2010 with a club and this led the deceased to commit suicide by hanging himself in his house.
The submission of the Petitioner's counsel is that, even in the inquest report, there is no indication of the injuries being caused to the deceased on account of the alleged assault by the Petitioner and, as far as the offence of abetment is concerned, the abusive words alleged to have been spoken to by the Petitioner cannot drive the deceased to take the extreme step of committing suicide and, therefore, the Petitioner be granted anticipatory bail and he would cooperate with the police in the investigation.
The Addl. S.P.P. for the State, though argued that the investigation is in progress, taking note of the aforesaid submission made by the Petitioner's counsel, I am of the view that the Petitioner can be granted anticipatory bail by imposing conditions to safeguard the interest of the prosecution.
In the result, the petition is allowed and the Petitioner be released on bail in the event of his arrest in Crime No. 174/2010 of Kanakapura Town Police Station, on his executing a personal bond for Rs. 25,000/- with two sureties for the like sum to the satisfaction of the arresting officer. He shall not tamper with the evidence and shall cooperate in the investigation by appearing before the I.O. on every Saturday between 10.00 a.m. and 5.00 p.m. and also on other dates as required by the I.O. The Petitioner shall not leave his place without the permission of the concerned I.O.
