Judgment
The petitioner undertakes to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The
petition is taken up through videoconference on the basis of such undertaking.
The grievance of the petitioner relates to the manner in which the trial is being conducted.
The learned advocate for the petitioner submits that the petitioner is in custody for about five and half years and the progress of the trial is very slow.
Having considered the fact that the recovery of contraband in this case relates to 550 kg. of Ganja, we are not inclined to release the petitioner on bail
at this stage. However, we direct the learned Special Court being the learned Additional District and Sessions Judge, 6th Court, Barasat, 24
Parganas (North) to expedite the progress of the trial and conclude the same preferably within one year from the date of regular resumption of
functioning of the court.
The trial court should not grant any unnecessary adjournment to either of the parties and the prosecution as well as the accused are directed to
cooperate with the court for expediting such progress as directed above.
With the aforesaid observation CRM 2207 of 2020 is disposed of.
