Judgment
This petition has been preferred because the respondent had issued notice as a result of non compliance of the rules and regulations for receiving the signals of the channels of the respondent. During the pendency of this petition, audit was conducted by the respondent of the Digital Addressable System of the petitioner under regulation 15(2) of the Interconnection Regulation 2017 and it was found by the respondent that there is no violation of any rules and regulations by the petitioner at this stage as is also submitted by the counsel for the respondent. Looking at the audit report, there is no violation by the petitioner at this stage. Counsel for the petitioner seeks permission to withdraw this petition, nonetheless, it is submitted by the counsel for the petitioner that liberty may be reserved with the petitioner to move this Tribunal again in case of any difficulty.
In view of this limited submission, this petition is hereby disposed off as withdrawn. Liberty is reserved with the petitioner to file a fresh litigation in case of any difficulty.
