Judgment
R.S., CJ
[1] The prayer in this writ petition is as follows:-
"ii. To issue a writ of mandamus or any other appropriate writ, order or direction thereby directing the Respondents to provide the financial assistance to the petitioner which he is entitled to under the centrally sponsored Scheme namely "Financial Assistance and support services to victim of rape : A Scheme for Restorative Justice."
[2] In this case, the mother has filed this writ petition for the above stated relief alleging that her daughter is a victim of sexual assault by a private tutor at his residence while the daughter was attending a tuition class. On 9th December, 2014, the petitioner has lodged a written report and a criminal case has been registered at Women Police Station, Imphal East under FIR No.24(12)2014 Women Police Station, Imphal East u/s 376(n)(f) IPC & 4 POCSO 2012. The petitioner also states that investigation is over and charge-sheet has been filed before the Court of Special Judge (POCSO), Manipur East in Special Trial case No.6 of 2015.
[3] In this background, the present petition has been filed seeking the benefit of relief and rehabilitation to victim of sexual assault.
[4] The petitioner and petitioner's counsel are advised to approach the Court of Special Judge (POCSO), Manipur East for interim relief under the victim compensation Scheme and also under the various Schemes provided by the Social Welfare Department as may be applicable to the facts and circumstances of the case.
[5] Counsels are directed to move an application to the Court below for such relief under the victim compensation Schemes and the same shall be considered by the Special Court without due delay.
[6] Before parting with this case, this Court was inclined to inform the petitioner and the counsel that the name of the victim has been repeatedly referred in the writ petition as well as in the synopsis and in other places which is prohibited by law. The counsel of the petitioner is advised not to disclose the name of the victim in any manner in further proceedings.
Writ petition stands disposed of with liberty as above.
