Judgment
THE opponents have filed and a Case No. 46/92 before the District Forum, Amreli. THE LIC has prayed that he complaint may be transferred from Amreli District Forum to any other District Forum on the ground that the Advocate of the complainant is the husband of one of the members of the District Forum and, therefore, there is likelihood of some prejudice on LIC.
WE are constrained to say that the applicant has not made any application for transfer to the President of the District Forum. Mr. Ashar, the learned Advocate appearing on behalf of the opponents states that if this objection was taken, he would never have appeared. Now, it was been settled that the President and one number can hear the matter and if this request had been made to the President, District Forum, Amreli, he would have heard the matter with the other member sitting in the bench. WE are of the opinion that merely because the husband of the member appears is not a ground for transferring the case. Every citizen must have faith in the Judge and if they are dissatisfied with the decision, they can file appeal, particularly when applicant is a statutory body. In any view of the matter, we do no find any merits in the transfer application and the same is dismissed with cost which is quantified at Rs. 150/-. Mr. Ashar makes a statement before us that he is not inclined to appear on behalf of the complainant in the instant matter it is taken up. ORDER The application is dismissed with cost which is quantified at Rs. 150/- (Rupees one hundred fifty only). Application dismissed with costs.
