Mr. S. Serto T. Kom, learned counsel, appears on behalf of the petitioner through video conferencing; and Mr. M. Devananda, learned Additional Advocate General, Manipur, appears on behalf of the State of Manipur.

The present habeas corpus petition has been instituted seeking a direction to the respondents to release Mr. Thangkholen Haokip, aged about 43 years, S/o. Paojatong Haokip, a permanent resident of Chikim Village, P.O. & P.S. Moreh, District-Tengnoupal, Manipur, in terms of the order dated 31.10.2023 passed by the Ld. Special Judge (ND & PS), Senapati, directing his release in connection with FIR No. 14(7)2022 GSPM-PS U/s 22 (C)/29/60(3) ND & PS Act.

Mr. M. Devananda, learned Additional Advocate General, appearing on behalf of the State of Manipur, on advance notice, states that in view of the foregoing circumstances, Mr. Thangkholen Haokip shall be released forthwith.

Mr. Serto T. Kom, learned counsel appearing on behalf of the petitioner through video conferencing, however, seeks liberty to approach the State of Manipur for protection in accordance with law during the course of the day.

Liberty granted.

Needless to state that, in the event of making of any request as aforesaid on behalf of Mr. Thangkholen Haokip, the State of Manipur is directed to determine the same, strictly in accordance with law, as expeditiously as possible.

Further, it is clarified that the parties are at liberty to file appropriate application before this Court, if any difficulty, in implementing the present order arises.

With the above direction, the present habeas corpus petition is allowed and disposed of.

Registry is directed to furnish a copy of this order to both the learned counsel appearing on behalf of the parties.
