Judgment

This is an application for regular bail.
Petitioner is the sole accused in Crime No.1 of 2021 of Marayoor Police Station, Idukki registered alleging commission of offences punishable under Sections 324 and 307 of the Indian Penal Code.
The prosecution case is that the accused due to the previous enmity towards the victim, on 01.01.2021 at 6.00 hours, in front of the shed of one Mr.Ramachandran at Nakkupetty Kara in Kanthalloor Village stabbed him with a knife causing grievous injuries to him. Thus the petitioner has committed the aforesaid offences.
Petitioner submits that he is in custody from 02.01.2021 onwards and that the investigation in the case is over and the charge sheet is already laid and the case is now pending as S.C.No.23 of 2021 before the Additional Sessions Court-IV, Thodupuzha. Petitioner further submits that the case is now posted for framing charge.
Learned Public Prosecutor upon instructions submitted that though the petitioner was granted bail in this case, it was cancelled due to violation of the bail conditions as he attacked the defacto complainant on 13.02.2022 and a crime was registered by the Marayoor Police as Crime No.99 of 2022.
Considering the facts and circumstances of the case and the nature of the allegations and also taking note of the detention of the petitioner from 02.01.2021 onwards, I am inclined to grant bail to him on the following conditions.
(i) The petitioner shall execute a bond for Rs.50,000/-(Rupees fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the jurisdictional court.
(ii) He shall appear before the investigating officer in Crime No.1 of 2021 of Marayoor Police Station, Idukki on all Saturdays at 11.00 a.m. till the completion of trial.
(iii) He shall not enter the jurisdiction limit of Marayoor Police Station, Idukki for a period of three months except for complying with any bail conditions or attending any proceedings before a court of law.
(iv) He shall not attempt to interfere with the investigation or to influence any witness in the abovesaid crime.
(v) He shall not involve in any other crime while on bail.
If any of the aforesaid conditions are violated, the investigating officer in Crime No.1 of 2021 of Marayoor Police Station, Idukki may file an application before the jurisdictional court, for cancellation of bail.
