The petitioner, a 26 years old woman, has filed this writ petition seeking a direction to terminate her two weeks old pregnancy. The amended provisions of the Medical Termination of Pregnancy Act, 1971 permits medical termination of pregnancy only upto 24 weeks and since it has crossed the statutory prescriptions, she approached this Court by filing the instant writ petition.
When the matter was taken up on 16.02.2023 for admission, this Court directed the Kalamassry Medical College to constitute a Medical Board, examine the petitioner and submit a report before this Court.
After conducting examination, a report is submitted before this Court and it reads thus:
Considering the facts and figures contained in the report of the Medical Board, I am of the view that a direction can be issued to Government Medical College, Kalamassery to conduct medical termination of the pregnancy of the petitioner at the earliest possible time. Accordingly, I do so. I make it clear that every effort shall be made to protect the life of the child.
This writ petition is disposed of as above.
The Medical Board is directed to place a report after the MTP is done, with respect to the health of the petitioner as well as the child.
